prisoner reported me. It was his duty to report me. I and another fokl were reported by him for being drunk. At that

time prisoner was only a constable. The case was investigated

by the sergeant. I did not get into trouble ofer that, nothing

eame of it. Besides these 3 occasions I have been cautioned

or punished on 9 other occasions. For the last "being asleep

on duty" I was dismissed. Then I was a ticket colleetor at

Yaumati Theatre. I resigned of my own account and went to

sea. There was a change of ownership of the theatre. I have been out of employment about 1 month. On this evening 3rd

August I walked from No 64 to No 60. I came down from No 64. It is a brothel. I live at No 100. I walked along under the verandah. I saw a crowd at No 60 under the verandah I was in front of the open part of No. 60. The sergeant wayed his hand. I did not hear him tell the crowd to go away. He pushed out

his hands. There was a row in front of me and he could not

reach me. Then the powd ran into the street and I also. I stood awhile, then left. In a minute or two, just as I reached street, the sergeant kicked the old man. I dont know whether he was in the crowd. At any rate he was under the verandah I did not go to assist him. He got up, sat up and then got up

the old man. and walked away. I only saw one man fall down,

I went to the Hospital and was shown a dead body. It was that of the old man who was kieked. I had not seen the dergeant before. I
